1. About these Terms
These Terms and Conditions (“Terms“) govern your use of the website of Rudolph & Timba Legal Practitioners (“the Firm“, “we“, “us” or “our“) at www.rudolphtimba.com and set out the general basis on which we make our website and information available. By accessing or using our website, you agree to be bound by these Terms. If you do not accept them, please do not use the website.
These Terms should be read together with our Privacy Policy.
2. About the Firm
Rudolph & Timba Legal Practitioners is a firm of legal practitioners registered in Zimbabwe and regulated by the Law Society of Zimbabwe. Our commitment is to deliver quality legal services with integrity and a high level of professionalism, devoting the requisite attention and expertise to each matter through a system of teamwork and peer-review.
3. No legal advice and no lawyer–client relationship
The content of this website is provided for general information only. It does not constitute legal advice, and it must not be relied upon as such.
Your use of this website, and any communication you send to us through it, does not create a lawyer–client relationship between you and the Firm. A lawyer–client relationship arises only once we have:
- completed our client acceptance, conflict-of-interest and due-diligence procedures; and
- agreed in writing to act for you under a signed letter or terms of engagement.
Until then, please do not send us any confidential or time-sensitive information through this website, as we cannot guarantee that it will be treated as confidential or acted upon.
4. Terms of engagement
Where we agree to act for you, the specific terms governing that engagement, including the scope of work, our fees and disbursements, billing arrangements, and each party’s responsibilities, will be set out in a separate letter or terms of engagement. In the event of any conflict between these Terms and a signed letter of engagement, the letter of engagement will prevail in respect of that matter.
5. Fees
Our fees are determined in accordance with the applicable Law Society of Zimbabwe tariff and any agreement reached with the client. Details of our fees, disbursements and payment terms will be provided in the letter of engagement for your matter.
6. Communications
We may communicate with you by email and other electronic means. You accept the risks associated with electronic communication, including the risk of interception, delay, non-delivery and the transmission of viruses. We take reasonable precautions to protect our systems but do not accept liability for loss arising from electronic communication except to the extent required by law.
7. Intellectual property
All content on this website — including text, graphics, logos, the “Rudolph & Timba” name and marks, and the arrangement of the site, is owned by or licensed to the Firm and is protected by intellectual property laws. You may view and print content for your own personal, non-commercial use. You may not otherwise copy, reproduce, republish, distribute or exploit any content without our prior written consent.
8. Acceptable use
You agree not to use the website:
- in any way that breaches any applicable law or regulation;
- to transmit any unlawful, defamatory, infringing or malicious material;
- to gain unauthorised access to, interfere with, or damage the website or any system or network connected to it; or
- in any manner that could disable, overburden or impair the website.

Our website may contain links to third-party websites. Those links are provided for convenience only. We do not control and are not responsible for the content, accuracy or availability of any linked website, and the inclusion of a link does not imply our endorsement.

While we take reasonable care to ensure that the information on this website is accurate and up to date, we make no representations or warranties, express or implied, as to its accuracy, completeness or fitness for any particular purpose.
To the fullest extent permitted by law, the Firm shall not be liable for any loss or damage (including indirect or consequential loss) arising from your use of, or inability to use, this website, or from reliance on any content on it. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.
This clause does not affect the terms governing our liability under any signed letter of engagement, which will be dealt with in that letter.
11. Confidentiality and privilege
Communications within an established lawyer–client relationship are subject to our professional duties of confidentiality and, where applicable, legal professional privilege. As noted in section 3, these protections do not apply to unsolicited information sent through this website before an engagement has been established.
12. Data protection
We process personal information in accordance with our Privacy Policy and the Cyber and Data Protection Act [Chapter 12:07].
13. Changes to these Terms and to the website
We may amend these Terms and the content of the website at any time. The version in force is the one published on the website at the time of your use, and the “Last updated” date above indicates when the Terms were last revised. Continued use of the website after any change constitutes acceptance of the amended Terms.
14. Governing law and jurisdiction
These Terms, and any dispute arising out of or in connection with them, are governed by the laws of Zimbabwe, and the courts of Zimbabwe shall have exclusive jurisdiction.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
